What Happens Before a Misconduct Panel? Lessons from the University of Sussex

At a recent Community of Practice session, colleagues from the University of Sussex shared how they've strengthened their student misconduct processes. One insight stood out: successful outcomes don't start in the hearing room. They start long before a panel is ever convened.
Sussex explained that everyone who sits on a misconduct panel completes mandatory annual training. This includes senior university leaders, investigating officers and Students' Union representatives. While each group receives role-specific training, the goal is the same: ensuring decision-makers are equipped with the knowledge and confidence to fulfil their responsibilities effectively.
The university has found that investing in training has been critical to improving both consistency and decision-making. Alongside covering disciplinary procedures, sessions explore areas such as trauma-informed practice, communication techniques, evidence assessment and how to apply the balance of probabilities when reaching decisions.
One particularly interesting takeaway was the emphasis on helping panel members understand how trauma can affect memory, communication and behaviour. Sussex shared that this has helped improve the quality of discussions and questioning during panel proceedings, creating a more informed and supportive process for everyone involved.
The university also highlighted the importance of practical skills, including the use of open questions, appropriate language and structured approaches to assessing evidence. By building these capabilities before cases arise, institutions can create greater confidence and consistency when difficult situations do occur.
